What is the Immigrant Investor Program?

The Immigrant Investor Program, also known as EB-5, is a government initiative designed to attract foreign capital and stimulate economic development by granting residency or citizenship to individuals who make a substantial financial investment in the host country’s economy.

What is a Regional Center?

An EB-5 Regional Center is a USCIS-designated organization that facilitates foreign investment in U.S. economic development projects under the EB-5 Immigrant Investor Program. These centers help investors meet the program’s job creation requirements by pooling funds into large-scale projects, such as real estate developments, infrastructure, and other job-generating ventures.

USCIS Designation

Approval: Dhanani EB-5 International is formally designated by USCIS to participate in the EB-5 program. This designation is granted after a thorough review of the center’s business plan, investment model, and proposed job creation strategy.

Ongoing Monitoring: Dhanani EB-5 International is subject to periodic reviews by USCIS to ensure we are continuing to meet program standards.

Job Creation Requirements

Job Creation Proof: Dhanani EB-5 International must demonstrate that its investment projects create at least 10 full-time jobs for U.S. workers per investor. The jobs can be either direct or indirect.

Econometric Modeling: Dhanani EB-5 International uses approved economic models to show how the project will generate the required jobs. The model must be accurate and well- documented.

Lawful Source of Funds

Documenting Funds: Dhanani EB-5 International must ensure that all EB-5 investments come from lawful sources, and a clear paper trail must be provided for investors’ funds, demonstrating that they were legally earned and transferred.

Know Your Investor (KYC) Compliance: Dhanani EB-5 International must ensure compliance with anti money laundering (AML) laws and verify the source of funds for each investor.

Investment and Use of Funds

Funds Allocation: The funds raised through EB-5 investors must be used in the specific project or business approved by Dhanani EB-5 International and detailed in the I-526 petition. Dhanani EB-5 International must ensure funds are not diverted or misused.

Risk Mitigation: Dhanani EB-5 International is required to structure investments in a way that minimizes the risk of loss for investors, ensuring their funds are used to support the project and meet EB-5 requirements.

Compliance with I-526 and I-829 Requirements

I-526 Compliance: Dhanani EB-5 International must provide thorough documentation and evidence in the I-526 petition to show that the investment project complies with EB-5 regulations (e.g., job creation, lawful source of funds).

I-829 Compliance: After investors obtain conditional residency, Dhanani EB-5 International must track job creation and investment performance to help ensure that the I-829 petition can be successfully filed, proving that the project has met its job creation goals.

Ongoing Reporting

Annual Reports: Dhanani EB-5 International is required to submit annual reports to USCIS, detailing the status of our projects, job creation progress, and use of EB-5 funds.

Investor Updates: Regular updates to investors are necessary to ensure that they remain informed about the status of the project and job creation.

Adherence to EB-5 Guidelines

Operational Transparency: Dhanani EB-5 International operates transparently, providing detailed and accurate financial and operational reports to both investors and USCIS.

Legal Oversight: Dhanani EB-5 International must comply with all U.S. securities laws, including providing proper documentation and disclosures to investors.

EB-5 Program

EB-5 Origin & Purpose

Congress created the employment-based fifth preference immigrant visa category (“EB-5”) in 1990 to benefit the U.S. economy by attracting investments from high-net-worth foreign nationals in return for lawful permanent resident status, commonly referred to as a “green card.” Congress intended to create and sustain American jobs by infusing foreign investment into the U.S. economy.

The Immigration and Nationality Act (INA) sets aside 10,000 visas each fiscal year (October 1 to September 30) for immigrant investors along with their spouses and unmarried children under the age of 21. USCIS has allocated a quota of 700 green cards per country each fiscal year.

Pursuant to the EB-5 Program, foreign nationals may pool their investments in economic entities (public or private) known as “Regional Centers” and claim credit for direct or indirect/induced job creation. Foreign nationals and their qualifying dependents initially receive conditional permanent resident status for a 2-year period, and if the investment and job creation requirements are thereafter satisfied, the conditions are removed, and unconditional lawful permanent resident status is granted.

PHASE 3: Permanent Residency

The I-829 petition bridges the gap between conditional residency and permanent residency.

STAGE 09

CONDITIONAL U.S. RESIDENCY PERIOD

Processing Time: 21-24 months.

Investor must visit the U.S. within 180 days of approval and at least once every six months.

Many investors apply for a Re-Entry Permit to reduce travel requirements.

STAGE 10

I-829 PETITION REVIEW & APPROVAL

File I-829 Petition to remove Green Card conditions and secure permanent residency.

Requires proof of sustained investment and job creation compliance.

Reviewed by USCIS and immigration attorneys before final approval.

STAGE 11

RECEIVE PERMANENT GREEN CARD(S)

Processing Time: 20-30 months.

Investors and their families receive permanent Green Cards.

Valid for 10 years and renewable indefinitely.

APPLY FOR U.S.

This property is located near the major thoroughfare of State Highway 249 and FM 1488. A short drive from Houston, Magnolia is poised for expansion with major corporate relocations and the arrival of the SH 249 toll way.

The project will consist of a series of three-story, wood framed, post-tensioned slab-on-grade buildings of two different types and 10 different unit types consisting of one-, two- and three-bedroom apartments. A separate building will house leasing offices and community space. The community building and grounds will contain various forms of tenant amenities, a pool, resident lounges, and fitness center.
